Enforcement Roundup – March 2025

The Enforcement Roundup is a monthly summary of enforcement-related activities in BC take by securities regulators.

The March 2025 Enforcement Roundup features five enforcement actions taken by the BC Securities Commission (BCSC). It also includes 16 new additions to the Investment Caution List.

Johny Panyavong 

The permanent ban resulted in Panyavong pleading guilty in BC Provincial Court in Surrey to theft and using forged documents. The court found that Panyavong misused $40,000 that he solicited from a BC investor in 2016 for investment in a Surrey real estate development.  

He used investor funds to pay personal expenses. When asked about the status of the investment, he showed the investor forged financial documents.

Hope Moira Donna Thomas 

The BCSC has permanently banned Thomas as a result of a previous finding by Canadian Investment Regulatory Organization (CIRO) that she had misappropriated a clients’ funds for her own use. Thomas opened a tax-free savings account (TFSA) for a CIBC client and opened a bank account with overdraft capability in the client’s name, without their consent or knowledge.  

She misappropriated a total of $157,000 for personal use. Thomas admitted she took the funds because the client was elderly and trusted her.

Oliver Barrett Lindsay  

Lindsay is a Canadian citizen who was living in Vancouver when he was sentenced in 2022 by a US federal judge. Lindsay has been permanently banned from the BC investment market.  

In 2017 and 2018, Lindsay and his co-defendant carried out a fraudulent trading scheme to create a false appearance of active trading in the stock of Kelvin Medical Inc. The gain attributed to his role in the conspiracy was almost $1.5 million.

BCSC Settlement Agreement  

Anish Sunderji and First Globe Capital International Inc.  

Sunderji, a Vancouver resident, and his company have jointly paid $120,000 for referring investors to purchase shares of companies without being registered. Sunderji was the sole director, officer, and shareholder of First Globe Capital International Inc.  

First Globe received $211, 384 in finder’s fees for referring investors to six listed companies. The investors bought $4,657,794 worth of shares in the companies through private placements. First Globe admitted that it was engaged in the trading of securities without being registered as required under the Securities Act.

Addy Technology Corp.  

Addy Technology Corp., A BC-based company that offers fractional investments in real estate, has paid $100,000 for engaging in the business of trading securities without being registered.  

Addy triggered the requirement to register by soliciting investments through its online platform, emails, social media, and by receiving compensation in the form of fees for the use of its online platform. Addy, which has no prior history of securities regulatory misconduct, voluntarily provided information to BCSC investigators and has since applied for registration as a dealer.

The BCSC Investment Caution List notifies British Columbians about unqualified investments and unregistered activity originating outside the province but accepts BC residents as clients.
